Parents Rights in Special Education (LAUSD) The Parent’s Guide to Special Education Services (Including Procedural Rights and Safeguards) has been revised on the District’s Division of Special Education website to reflect modifications required from a special education compliance investigation and in accordance with Education Code 56346(e) and 56346(f). The revised language provides the following information to parents:

1. If you consent in writing to the receipt of special education and related services for your child yet do not consent to all of the components of the IEP, those components of the program to which you consent shall be implemented so as not to delay providing instruction and services to your child. You are not required to initiate any form of dispute resolution as to components of the IEP to which you do not consent.

2. With the exception of a situation in which you fail to respond or refuse to consent to the initiation of services for the initial provision of special education and related services to your child, the District shall initiate a due process hearing if the District determines that the proposed special education program component to which you do not consent is necessary to provide a free appropriate public education to your child.If a due process hearing is held, the hearing decision shall be the final administrative determination and shall be binding upon the parties.While a resolution session, mediation conference, or due process hearing is pending, your child shall remain in his or her current placement, unless you and the District agree otherwise.
